Any information provided, created or obtained in the course of this Settlement, whether written or oral, will be kept confidential by the Parties, Class Counsel, the Claims Administrator, the Independent Reviewer and the Exceptions Committee, except as required to be disclosed by law, and will not be used for any purpose other than this Agreement unless otherwise agreed by the Parties.

Except as may otherwise be agreed between the Parties, this includes discussions and all communications, whether written or oral, made in and surrounding the negotiations leading to the Agreement in Principle and this Agreement.

Data Security

We implement reasonable security measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Retention of Information

We retain personal information for as long as necessary to fulfill the purposes outlined in this policy, comply with legal obligations, and resolve disputes. The Claims Administrator will destroy all Claimants’ information and documentation in its possession on a schedule beginning no sooner than two years after completing the compensation payments, in accordance with the Data Disposition Protocol to be developed by the Parties in consultation with the Claims Administrator and approved by the Court.
