Compensation Reconsideration
If you received a Compensation Letter and the level is lower than the level you identified on your Claim Form or you were denied compensation, you may be able to ask for a Compensation Reconsideration. This page explains when it is available and how it works.
What is a Compensation Reconsideration?
A Compensation Reconsideration is a review of the compensation decision on your Claim. An Independent Reviewer, a neutral decision-maker appointed by the Court, looks at your Claim and makes a final decision.
The Independent Reviewer is separate from the Claims Administrator and the Government of Canada.
The Independent Reviewer’s decision is final.
Who can request a Compensation Reconsideration?
You can request a Compensation Reconsideration if:
- You received a Compensation Letter, and
- The compensation level is lower than the level you identified on your Claim Form and you disagree with the decision, or
- You are not entitled to compensation
What happens during the Reconsideration?
The Independent Reviewer looks at your Claim and makes a decision.
In complex cases, your Claim may be referred to the Exceptions Committee.
The Exceptions Committee is a committee that guides special or unusual Claims. The Exceptions Committee is asked to review a Claim only when something is unclear or needs more guidance.
The process takes time.
A Claims Helper or Class Counsel can answer questions about timing.
What are the possible outcomes?
Three outcomes are possible after the Independent Reviewer or the Exceptions Committee makes a decision:
1.
The compensation level is kept or increased.
2.
The compensation level is decreased.
3.
The Claimant is not entitled to compensation.
After the Independent Reviewer makes a decision, the compensation decision is final.
You will receive written notification of the decision.
