Eligibility Reconsideration

If you received an Eligibility Decision Letter and you disagree with the decision, you can ask for an Eligibility Reconsideration. This page explains how.

What is an Eligibility Reconsideration?

An Eligibility Reconsideration is a review of the eligibility decision on your Claim.

An Independent Reviewer, a neutral decision-maker appointed by the Court, looks at your Claim and makes a final decision.

If the Government of Canada disagrees with an eligibility decision, it may also ask for Reconsideration of the decision by the Independent Reviewer. However, this would take place before you receive an Eligibility Letter.

If this were to happen, it would be done before you are notified of the eligibility decision.

The Independent Reviewer is separate from the Claims Administrator and the Government of Canada.

The Independent Reviewer’s decision is final.

Who can request an Eligibility Reconsideration?

You can request an Eligibility Reconsideration if you disagree with the eligibility decision on your Claim.

How to request a Reconsideration

You have 120 days from the date of the Eligibility Decision Letter to request a Reconsideration. After the 120 days have passed, if a request for Reconsideration has not been received, the decision is final.

Your Eligibility Decision Letter explains how to make a request and provides an opportunity to provide clarifying information, further detail about your experience or documents you may have available.

Medical records are not required during the Reconsideration process or at any point in the Claims Process.

What happens during the Reconsideration?

The Independent Reviewer looks at your Claim and makes a decision.

In complex cases, your Claim may be referred to the Exceptions Committee.

The Exceptions Committee is a committee that guides special or unusual Claims. The Exceptions Committee is asked to review a Claim only when something is unclear or needs more guidance.

The process takes time.

A Claims Helper or Class Counsel can answer questions about timing.

What are the possible outcomes?

Two outcomes are possible after the Independent Reviewer reviews your Claim:

Eligible:

Your Claim moves to the compensation review stage.

Not eligible:

The eligibility decision is final. No further Reconsideration is available.

You will receive written notification of the decision.
