Who Is Eligible to submit a Claim?

You may be eligible if:

You were admitted to one of 33 Federal Indian Hospitals included in Schedule D – Federal Indian Hospitals List
while it was operated by the Government of Canada;

and

You suffered abuse, including psychological, verbal, physical and/or sexual, while admitted to one of these Federal Indian Hospitals.

This Settlement does not include compensation for medical malpractice or claims connected to medical treatment.

Primary Class Members

A Primary Class Member is someone who was admitted to a Federal Indian Hospital while it was operated by the Government of Canada and who experienced psychological, verbal, physical, and/or sexual abuse while they were admitted. Only Primary Class Members can receive individual compensation.

Class Members who have passed away

An Estate Representative or Heir may submit a Claim for a Primary Class Member who passed away on or after January 25, 2016. Someone acting for the estate, like an executor, administrator, or Heir, submits the Claim.

Personal Representative

If a Claimant is a Person Under Disability and unable to manage their own affairs a Personal Representative may complete and submit the Claim on their behalf.

Family Class Members

Family Class Members are close family members of a Primary Class member like spouses, children, grandchildren or siblings. Family Class Members are not eligible for individual compensation.

All Class Members will benefit from the work of a Foundation established by the Settlement and additional funding to existing Indigenous Services Canada programs . These initiatives will collectively support healing, wellness, truth, reconciliation, cultures, protection of languages, commemoration as well as research and education.

Dr. Mike DeGagne has been appointed by the Court to lead an extensive cross-country engagement process on the creation of the future Foundation.

Beginning in spring 2026, Dr. DeGagne will meet with class members and their families, and experts to inform the design and leadership of the Foundation, as well as the activities it will undertake.
