Eligibility Information Tool acceptable use policy

The Eligibility Information Tool (“Tool”) is not a Claim Form; it is a starting point to help you understand whether you might qualify for compensation in this Settlement. It cannot give a final answer, as many factors can affect eligibility.

To participate in the Settlement, you must complete and submit a Claim Form. You can find Claim Forms on the Forms and Guides page.

The Eligibility Information Tool can be used to understand whether you meet the eligibility criteria for the Federal Indian Hospitals Settlement. It is not a Claim Form.

This acceptable use policy (the “AUP”) describes the acceptable use of and access by you (the “User”) to this Tool offered by Castlemain. By accessing or using the Tool, you agree to the following terms of this AUP. You will not violate this AUP or authorize or helps others to do so. If you do not agree to be bound by any of these terms, please do not use the Tool.

Purpose of the tool

The Tool is intended for informational purposes only. It allows you to carry out a preliminary, non-binding assessment of whether you may meet the eligibility requirements to submit a Claim. It does not constitute legal advice or a final determination of eligibility for compensation. Please note that you cannot submit a Claim through the Tool.

No legal relationship

Use of this Tool does not create an attorney-client relationship. You can contact Class Counsel for advice with respect to legal matters related to the Settlement. You can also hire your own lawyer.

Intellectual property

All intellectual property rights of the content in the Tool, including copyright are owned by the Notice Administrator or its licensors.

Accuracy of information

You are responsible for ensuring that all information you input into the Tool is accurate and complete. The results generated by the Tool are based solely on the information you input into the Tool and may not reflect your actual eligibility under the terms of the Settlement.

Disclaimer of warranties

The tool is provided “as is” and without warranties of any kind, either express or implied. We do not guarantee that the Tool will be accurate, complete, reliable, or error-free.

Limitation of liability

To the fullest extent permitted by law, the Notice Prover disclaims any liability for any direct, indirect, incidental, or consequential damages arising out of or in connection with your use of the Tool, including reliance on any results generated.

Privacy

We do not collect and process personal information through this Tool.

Tracking

The tool collects data voluntarily provided, and uses cookies and similar tracking technologies to:

  • Monitor interaction with the Tool;
  • Store aggregate session data, such as views, starts, and completes;

Store aggregate user behaviour data, such as geographic region, device, browser, traffic sources, and shares.

Modification and termination

We reserve the right to modify or discontinue the Tool, or to change these terms at any time. Your continued use of the Tool after any changes constitutes your acceptance of the updated terms.
